  1. You may link to the images on pages you maintain for yourself for personal, non-commercial use.
  2. If you are preparing FREE online site guides for other photographers, bloggers, and photography forums, you may make use images for critique, commentary,  and/or learning but only if the attribution guide, above, is followed.

IV. Commercial Use

Those persons who wish to use the photography found on this site in a commercial fashion must receive written consent from me, Toni Castillo, prior to its commercial use. If the work contains another person, they also must give consent. Payment to the photographer and portrait client may be required.

V. Copyright Protection Tactics

In attempts to maintain the integrity of the copyrighted photographs found on this site, several copyright protection methods have been utilized. Some of these tactics include, but are not limited to:

  1. Placement of watermarks, particularly in EXIF data
  2. Resizing of images
  3. Conversion of images to low resolution for web use
  4. Digital tracking of images
  5. Reverse image searches

Since the majority of the images are commissioned by private parties for personal use, they are not for sale. Portrait clients appearing on this site have granted permission for images to be used in the marketing of Toni C.'s photography services, but no wider use. Violating the photographer's copyright also violates the rights of the portrait client. Portrait clients retain the right to legal action against copyright violations.

VI. Copyright Infringement is Serious

The act of infringing on a copyright is a very serious business and is punishable by fines and/or imprisonment. The words and images on this site, and any other site associated with ACCreative, LLC, are the work of one person (the photographer), often in contracted conjunction with one or more parties (clients and contributors). Rights between the parties are stipulated, and followed. None of the work here is released under the Creative Commons. Everything is created with the intention of retaining all rights under US Copyright Law.

The U.S. Copyright Law (Title 17, United States Code) protects photographers and other artists by granting them the exclusive right to distribute, copy, edit and publish their photography by license, transfer, or sale. The Copyright Law prohibits anyone from copying, scanning, editing or sharing photographic prints, images, or media without the written permission of the photographer. Violation of the Copyright Law can incur both civil and criminal penalties.

If you admire the work, you're more than welcome to book a portrait session of your own. If that's not an option, requesting permission is only a short email away. Most non-commercial usage, with proper attribution, is not a problem.

If you're a portrait client, you have your own set of rights. Ask during the Consultation, or review the Portrait Contact you've signed.

This page is originally the work of photographer Theodore A. Stark, who granted permission for the text to be used here. It's easy to get permission: email and ask.
